What Happens if You Have No Heat This Winter?

Did you know that having no heat in your residential or commercial building can result in a complaint being filed against your building? The city of New York requires heat to be provided in buildings between October 1st and May 31st. If your building is out of heat for any amount of time during those days, a resident or employee could file a complaint with the city, and that complaint will be received by the Department of Housing Preservation (HDP). Commercial and Residential Heat Requirements for New York City

The building code for heat applies to both residential and commercial buildings, this includes multi-unit family buildings, condos, co-ops, apartments, government buildings, senior centers, drug rehabilitation centers, including day treatment facilities, and any building where commercial business is performed. From October 1 to May 31, HDP accepts building complaints for heating violations, and this includes boilers, furnaces and heat pumps that are not functioning.
  • Heat must be provided in residential and commercial buildings between the hours of 6:00 AM and 10:00 PM anytime the outside temperature is below 55-degrees Fahrenheit.
  • For the overnight hours between 10:00 PM and 6:00 AM, the inside building temperature must not fall below 62-degrees Fahrenheit.
What Happens if You Break Housing Code?
It’s important to understand that when your building has no heat, you are breaking the housing code for NYC, and you are breaking the law and putting people’s lives at risk. If anyone freezes to death during your building’s heating outage, you could be held liable.
Once a complaint has been received, an inspector will come out to your building and inspect it for loss of heat. While they are there, they may find other violations. When you receive your violation(s), you could have as little as 24 hours to correct the problem. You’ll also be subjected to fines and other penalties, and you will receive a date to appear in housing court. Likewise, if the resident or employee who filed the complaint is not satisfied with the repair or the repair is not made, the resident or employee can escalate the complaint to housing court.
